The conference on "Current situation in the field of application of family legislation related to the termination of marriage" was held with the organization of the State Committee on Family, Women and Children Affairs, Supreme Court of the Republic of Azerbaijan and the Bar Association of the Republic of Azerbaijan on May 19, 2023.

Welcoming the participants, Mrs.Bahar Muradova, the Chairperson of the Committee, said that the purpose of the conference is to listen to the proposals regarding the current situation in Azerbaijan regarding the mentioned topic, either in the legislative aspect, or in the direction of creating useful and efficient mechanisms, and to exchange ideas on the work to be done in connection with their application.

Emphasizing that the family is the core of society, the Chairperson of the Committee noted that every state is interested in the formation of a family institution with unshakable moral foundations. Because only a strong family, physically and spiritually healthy generation can play the role of the foundation of a strong state and society.

Pointing out that a number of important documents are currently being implemented in the country, the chairperson emphasized the importance of protecting the rights of women and girls, children, and family values in each of the programs implemented by the President, such as the Sustainable Development Goals, the Strategic Roadmap, and the "Azerbaijan 2020: Vision of the Future" Development Concept.  

Mrs. B. Muradova stated that it is planned to open new Family Centers in three regions, and said that service-communication and referral process will be implemented in these centers.

Bringing to attention the information about the study called "Social-psychological analysis of the family" prepared by the order of the committee, the chairperson said that this analysis opened new directions for the activity of the committee, and that there are a number of urgent issues waiting to be solved.

She added that "I appreciate the activity of the Supreme Court in this direction. It is very important for us that the Supreme Court is a partner in holding this conference. I believe that we will consistently work together in this direction."

Mr. Anar Bagirov, The Chairperson of the Presidium of the Bar Association, said that principled and continuous measures were taken to solve the social problems of families, and a legislative framework was created that regulates family relations, based on modern national values and international practice during the leadership of the great leader Heydar Aliyev.  

Noting that the number of divorces has decreased compared to last year, Mr. A. Bagirov added that, despite this, the current number is quite high.

Drawing attention to the issue of early marriage, Mr. Anar Bagirov said that such marriages lead to violations of human rights such as health protection, education, labor and privacy rights.

Mr. Sanan Hajiyev, The Chairperson of the Civil Board of the Supreme Court, who spoke later, noted the relevance of the topic and expressed his confidence that the conference will achieve its goals.

He said that because the existence of the family and its protection is one of the necessary conditions for the development of society, our state always pays special attention to the issue of strengthening marriage.

Mr. Nadir Adilov, Chairperson of the Board of Mediation Council, who brought to attention the information related to mediation processes, pointed out that 31 mediation organizations and 300 mediators are currently operating across the country.

He spoke about the difficulties in appointing worthy, professional candidates to increase the mentioned number. Speaking about the various reasons that cause family disputes, the chairperson announced the statistics of requests for mediation related to these problems.

Noting the relevance of the conference's theme, Mr.Adil Valiyev, the head of the Social Legislation Department of the Milli Majlis, pointed out that the problem is multi-spectral and emphasized the importance of adopting a number of legal-normative acts for the purpose of implementing preventive mechanisms.

The conference continued with the discussion of the opinions voiced in the speeches, the creation of an alimony fund, the conclusion of a marriage contract, and the application of mandatory mediation processes were exchanged.
